Laws
Support Pakistan’s
War against Taliban: Dr Niaz A Shah
Pakistan’s fight against Taliban
is legitimate and justified in the perspective of Islamic Sources
of Law , Domestic Laws of Pakistan and International Law ,
concluded Dr. Niaz A. Shah, lecturer of Law at University of
Hull while speaking on the topic ‘Fighting the Taliban–A legal perspective’ at
the Pakistan High Commission , here , yesterday. The
talk was organized in the context of
Pakistan’s ongoing war against
terrorism.
Deliberating on the relevant
portions of Laws in depth Dr. Niaz in his talk highlighted that the
Government of Pakistan’s action against the militants was legitimate as the
Domestic Law, Islamic law as well as International Law were on Pakistan’s side
in the context of the military action.
He candidly presented his
arguments in support of his assertion by quoting the Constitution of Pakistan
1973, Anti-Terrorism Act 1997, Pakistan Penal Code 1860, Criminal Procedure
Code 1898, Pakistan Army Act 1952 and Frontier Crimes Regulation 1901. He also
cited references from the Holy Quran, which forms the basis of the Islamic law
to prove his point that military action against Taliban was covered under all
the three laws. He, however, emphasized that all laws take into account the
obligations of the state to ensure that the human rights were observed.
Intellectuals and Government
officials from different walks of life attended the lecture, which was followed
by lively Q&A Session.
The High Commission intends to
arrange more such lectures pertaining to the contemporary issues of
international concern and interest.
